OPINION
OF THE HELSINKI COMMITTEE FOR HUMAN RIGHTS
CONCERNING
THE LAW ON THE SALE OF APARTMENTS WITH
TENANTS' RIGHTS
Following the initiative of a
certain number of citizens, The Helsinki
Committee for Human Rights in BH has considered
the text of the Law on Sale of Apartments with
tenants' rights, especially, the article 47,
paragraph 2 of the Law.
The provisions of this article
are discriminatory since they do not equally
treat certain catagories of holders of tenant's
rights. Besides, such solution brings into
question the realization of rights of the owners
of apartments as well as the holders' of tenants
rights.
In the opinion of the Helsinki
Committee such proposals only postopone the
solution of one of the greatest problems.
Having in mind numerous aspects
of sale of apartments with tenants' rights, and
stressing inalienable right to ownership and to
right to dwell, we ask for protection of rights
of holders of tenants' rights and that the state
be obliged to adequately compensate the owners of
housing units.
